David H. Rich, a partner with Todd & Weld LLP, was quoted in the September 24, 2012 issue of Massachusetts Lawyers Weekly. Mr. Rich offered his views regarding privacy issues raised in a suit brought by a group of plaintiff shareholders against Bain Capital in the United States District Court for the District of Massachusetts. Over the past five years, most pleadings in the case have been filed under seal. Recently, attorneys representing The New York Times sought to lift the order sealing the documents. Mr. Rich is not connected with the suit.

As reported in the Lowell Sun on April 21, Middlesex Superior Court Judge Gary Inge ordered the owners of the Meadow Creek Golf Club in Dracut, Massachusetts, to comply with the terms of a cease and desist order issued by the Town of Dracut and to escrow $2,000 to pay the fines levied by the Town so that Todd & Weld's client, Realty Financial Partners, would not be left to foot the bill as the co-special permittee.

An article in the February 20, 2012 edition of Massachusetts Lawyers Weekly, entitled “Newspaper Sued for Identifying Wrong Man as Accused Rapist,” described the suit for defamation filed by David H. Rich, a partner with Todd & Weld LLP, on behalf of his client Angel Ortiz. A front-page story about a man named Angel Ortiz who had been indicted on charges of raping a 12-year-old girl was published by the MetroWest Daily News, but included a picture of the wrong Angel Ortiz. “In our society today, one can hardly be accused of anything worse than child rape,” said Mr. Rich. On November 2, 2011, the Boston Business Journal reported on a suit filed last month by Tyler E. Chapman, a partner with Todd & Weld LLP, on behalf a group of plaintiffs who purchased condominiums at Nouvelle in Natick, Massachusetts. The suit against Natick Residence, LLC and Howard Hughes Corp. alleges “fraud in the inducement” based upon the developers' misrepresentations about its financial condition and about the project's condition.

In a Massachusetts Lawyers Weekly article reporting the decision of the U.S. Court of Appeals for the First Circuit, EMC Corporation v. Arturi, et al., in which the First Circuit determined that an employer cannot equitably extend a noncompetition covenant after its expiration and instead is left with a damages remedy alone, Christopher R. O'Hara of Todd & Weld lent his expertise to the discussion and analysis of the First Circuit's ruling. The plaintiff employer, EMC Corp., cited five unreported Massachusetts Superior Court decisions. Mr. O'Hara was counsel to the employer in one of those cases: Oxford Global Resources v. Consolo, 16 Mass. L. Rptr. 415 (Super. Ct. June 6, 2003)(Botsford, J.).

David Meier, Formerly Chief of Homicide with Suffolk County DA'S Office, Joins Todd & Weld LLP
Todd & Weld LLP has announced that David Meier will join the firm on March 3, 2008. Mr. Meier has been with the Suffolk County District Attorney's Office since 1996, most recently serving as the Chief of Homicide. During his time with the DA's Office, he was responsible for extensive grand jury investigative work, trial of major homicide cases, and briefing and argument of appellate cases and issues. He acted as the lead state prosecutor in multi-agency investigations involving federal, state, and local law enforcement issues.
