Alycia Kennedy was quoted in a news article detailing the financial struggles Massachusetts school bus companies are facing due to COVID-19 restrictions on in-person student attendance.
The firm, including Howard Cooper, represents several school bus companies suing Massachusetts municipalities for unpaid fees following the closure of the city’s schools due to COVID-19. The central dispute concerns payment for the continued provision of various services during the shutdown as required under the parties’ contract – even when students were not being transported to school.
Regarding a pending lawsuit against the City of Lowell, Ms. Kennedy told boston.com that the firm’s client is “not looking for a handout from the city or anything. [It’s] just looking for compensation for the services that they did provide.”
Remarking on the contractual dispute, Ms. Kennedy added: “We obviously disagree with the city’s interpretation of the contract. It’s clear that the contract requires all of these services to be continuously performed and [the client] performed them, and now the city is refusing to pay for these services that were ordered and rendered.”
