Ian Pinta comments in news article on judge's denial of attendance at deposition
A Massachusetts Superior Court judge denied the request of a former head of a now-defunct corporation to appear at a deposition after she had settled her claims and was no longer a party.
According to the judge, once the former head of the company reached a settlement, she forfeited her right to confront fact witnesses in the ongoing case, according to an article published by Massachusetts Lawyers Weekly.
Ian Pinta, a partner at the firm, told the publication that the judge made the correct ruling.
“If you are a party, you are granted certain rights and have certain duties under the rules,” Mr. Pinta said. “If you are no longer a party, you lose some of those rights.”
Mr. Pinta concentrates his civil litigation practice on complex commercial disputes.
