Joe Cacace quoted in news article detailing FTCA lawsuit filed on behalf of migrant children separated from families at border

Joseph Cacace is quoted in a Worcester Telegram-Gazette article detailing the Federal Tort Claims Act lawsuit filed by the firm on behalf of migrant children separated from their families at the U.S.-Mexico border.

“These children and these families need help, and they deserve some sort of compensation and remedy (for what happened),” Mr. Cacace told the publication.

As alleged in the lawsuit, the children suffered severe emotional distress and, in some cases, physical abuse after being unlawfully separated from their parents. 

Both families were fleeing violence in Guatemala, including one who had received death threats from organized crime members. 

The lawsuit asserts counts of intentional and negligent infliction of emotional distress, false imprisonment, false arrest, assault and battery, negligent supervision, loss of parental consortium and tortious interference with the parental-child relationship. 

Howard Cooper of the firm is also representing the children in the lawsuit.

The firm also represents the same children in a previously filed lawsuit asserting constitutional and federal statutory claims stemming from the border separation of their families.  That case is currently on appeal to the U.S. Court of Appeals for the D.C. Circuit.
