Joseph Cacace quoted in article on suit seeking damages for migrant children separated from families at border
Joseph M. Cacace is quoted in a Law360 article concerning the attempt by the Department of Justice to have dismissed a proposed federal class action seeking damages on behalf of migrant children forcibly separated from their parents at the U.S.-Mexico border.
Howard M. Cooper and Mr. Cacace, along with other attorneys and organizations, filed the lawsuit on behalf of migrant children against various Trump Administration officials. The complaint describes egregious violations of the constitutional and civil rights of immigrant children.
The suit seeks the establishment of a mental health fund to treat the thousands of children who were forcibly separated from their parents at the border. The suit additionally asserts that the government is liable under the Federal Tort Claims Act for causing permanent emotional and psychological harm to children separated from their parents.
"[The] plaintiffs will be responding to the defendants' motion to dismiss in court in due course and fully expect to hold the defendants accountable for their actions, which resulted in the unnecessary and unlawful forcible separation of well over 2,500 migrant children from their families," Mr. Cacace told Law360.
