Spring 2019 Family Law Newsletter: Bankruptcy filing doesn't protect retirement account from creditors
The recently published Spring 2019 Family Law Newsletter highlights a recent federal appeals court ruling that a man's bankruptcy filing did not protect from creditors his retirement account funded from his ex-spouse's 401(k) fund divided as part of their divorce.
The court determined that retirement funds received in a divorce are not exempt from creditors, unlike most retirement accounts which are protected against collection by creditors.
