Spring 2022 Family Law Newsletter: Reduced income after business sale may not reduce alimony
The recently published Spring 2022 Family Law Newsletter addresses recent court decisions on whether a business sale that reduces an individual’s income can justify a reduction in alimony payments.
In one case an appellate court rejected a dentist’s argument that the sale of his practice and resulting lower income were “changed circumstances” justifying a reduction of his alimony payments.
The court found that the lower court judge did not thoroughly investigate whether the husband was acting in good faith or whether he was deliberately creating “changed circumstances” to thwart the original alimony order.
