Firm obtains $500K settlement in case involving elderly woman who died from a fall in transportation van
The firm obtained a $500,000 settlement in a wrongful death case involving an 88-year-old woman who died from a fall in a transportation van.
On Jan. 24, 2019, the woman was standing unrestrained in a van with a walker while awaiting to exit at a senior day care center in Massachusetts. The driver of the van instructed her to remain standing while he pulled forward to allow for easier unloading.
As the driver moved the van forward, the woman lost her balance and fell backwards to the van floor. The driver in an accident report admitted he overestimated the woman’s ability to maintain her balance and was at fault for causing her to fall.
After the fall, the woman reported a sharp pain in her lower back and slight dizziness. She was taken to a hospital for evaluation, where there was no objective evidence of any injuries.
Following physical rehabilitation, she was discharged to her home where she died 11 days after the accident.
During litigation, plaintiff’s counsel permitted defense counsel to take recorded interviews of her children regarding the impact of the loss of their mother. The case settled pre-suit one month after the interviews.
